The Consumer Complaints Ratio Report is developed as follows:

  1. The company's total complaints under the policy type for the calendar year are summed as "Total Complaints." Note that "Total Complaints" include only confirmed complaints, which are defined as follows:

    A Confirmed complaint is a complaint in which the state department of insurance determines:

    1. The insurer, licensee, producer, or other regulated entity committed any violation of:
      1. an applicable state insurance law or regulation;
      2. a federal requirement that the state department of insurance has the authority to enforce; or
      3. the term/condition of an insurance policy or certificate; or

    2. The complaint and entity's response, considered together, indicate that the entity was in error.

    Confirmed Complaints include those complaints in which one of the complaint resolution codes used by the state, also known as the "complaint disposition," upheld the consumer's complaint position. Complaint resolutions that uphold a consumer's complaint position are as follows (implemented on 12/13/2010): Compromised Settlement/Resolution; Claim Reopened; Claim Settled; Fine; Referred for Disciplinary Action; Company Position Overturned.

  2. The company's "Total Complaints" are divided by the sum of the complaints of all companies under the policy type for the calendar year. This calculation provides the company's "Complaint Share" of all complaints, nation-wide, under the policy type for the calendar year.

  3. The company's total premiums under the policy type for the calendar year are summed as "Total Premiums." Please note that "Total Premiums" represent only those premiums associated with business inside the U.S., since complaints are not collected for business outside the U.S.

  4. The company's "Total Premiums" are divided by the sum of the premiums of all companies under the policy type for the calendar year. This calculation provides the company's "U.S. Market Share" of all premiums, nation-wide, under the policy type for the calendar year.

  5. The company's "Complaint Share" is divided by the company's "U.S. Market Share" to obtain the company's "Complaint Index" under the policy type for the calendar year.

  6. The company's "Complaint Index" is divided by "National Median Complaint Index," which is the median complaint index of all company indices obtained under the policy type for the calendar year. This calculation provides the company's "Complaint Ratio" relative to the "National Median Complaint Ratio", which are both identified at the top of the report. Note that the "National Median Complaint Ratio" is always 1.00, since the "National Median Complaint Ratio" represents the "National Median Complaint Index" divided by the "National Median Complaint Index."
